Terms of Service

These Terms are a template provided with the HireCheck platform and should be reviewed by your legal counsel before publication. By using HireCheck, you agree to these Terms.

1. Acceptance

By creating an account or using the service, you agree to be bound by these Terms and our Privacy Policy. If you use the service on behalf of an organisation, you represent that you are authorised to bind it.

2. Accounts & eligibility

You must provide accurate information and keep your credentials secure. Employer accounts must complete KYC verification before requesting checks. You are responsible for activity under your account.

3. Employer obligations

  • Request verifications only for legitimate, lawful hiring or engagement purposes.
  • Obtain and rely on candidate consent provided through the platform.
  • Use reports confidentially and only for the stated purpose.
  • Attest employment records and references truthfully.

4. Candidate rights

Candidates control whether a check proceeds, can view the scope of each request, can revoke consent, and may dispute inaccurate records. We will not generate a report about a candidate without their consent.

The platform operates on per-check, scoped, time-bound consent. You agree not to circumvent consent controls, and not to use the service to build profiles, scores, or databases outside the consented purpose.

6. Prohibited use

  • Searching or profiling individuals without their consent.
  • Uploading false KYC information or impersonating a company.
  • Reselling, scraping, or redistributing reports or data.
  • Attempting to breach security, rate limits, or access controls.
  • Any use that violates applicable law or third-party rights.

7. Billing & credits

Paid plans are billed via our payment processor. A report credit is consumed when a report is generated following consent. Refunds are governed by our Refund Policy.

8. Intellectual property

The platform, its software, and branding are owned by HireCheck or its licensors. You retain rights to data you submit, granting us a limited licence to process it to provide the service.

9. Disclaimers & liability

The service is provided “as is”. We verify information supplied by employers and references but do not guarantee its absolute accuracy. To the maximum extent permitted by law, our aggregate liability is limited to the fees you paid in the preceding three months.

10. Termination

You may close your account at any time. We may suspend or terminate access for breach of these Terms, fraud, or misuse, subject to applicable law and our retention obligations.

11. Governing law

These Terms are governed by the laws of India, with exclusive jurisdiction of the courts at your registered place of business, unless otherwise required by law.
